CBA Seeks Amended Language to Intimate Deepfakes Bill
On Monday, April 21st, Justin Sasso, representing the members of the CBA testified before the Senate Judiciary Committee on Senate Bill 25-288, “Intimate Digital Depictions Criminal & Civil Actions.”
The proposed legislation would have allowed broadcasters to be held civilly and criminally liable for the broadcast of a deepfake or AI created intimate image. While broadcasters are required to uphold community standards of decency and are highly unlikely to ever knowingly air a non-consensual or obscene image, broadcasters still air a wide range of content produced by networks, advertisers, or other third parties.
The CBA requested amended language to SB25-288 protecting broadcasters who didn’t create the content, didn’t know it was an unauthorized fake, and who take it down quickly upon notification. The amendment was adopted helping to avoid putting pressure on stations to reject legitimate third-party content out of fear of accidental liability. |
